Exchange and Returns Policy (Spain)

1. Nature of our products

All our baby garments are made by hand, to order, and in many cases adjusted to approximate measurements or customizations requested by the customer.
Each item is manufactured specifically for each order, which is why we do not keep stock.

2. Right of withdrawal (art. 103.c of RDL 1/2007)

In accordance with article 103.c of Royal Legislative Decree 1/2007, the right of withdrawal does not apply to:

"The supply of goods made to the consumer and user's specifications or clearly personalized."

This means that returns due to a change of mind are not accepted for items made to order, personalized, or custom-made.

3. Exchanges due to manufacturing error

Even though these are custom-made products, we offer the possibility of adjustments or exchanges in the following cases:

  • Size error attributable to the workshop (e.g.: a different size than requested was delivered).
  • Incorrect personalized measurements or details compared to what was indicated in the order.

In these cases, the shipping costs resulting from the exchange will be covered by us.

If the error stems from incorrect measurements provided by the customer, we may offer:

  • Adjustment or modification, if possible (may involve an additional cost).

  • A discount on the manufacturing of a new garment.

( Pickup and shipping costs will be borne by the customer )

4. Defective or non-conforming product (legal warranties)

If the garment has a manufacturing defect or does not conform to the contract, the customer may request:

  • Repair

  • Replacement

  • Refund (only if the above options are not possible)

According to RDL 1/2007, notification must be made within a reasonable period after detecting the non-conformity. We recommend reporting it within a maximum of 48–72 hours of receiving the order to speed up the process.

To handle the issue, the following will be requested:

  • Order number

  • Description of the defect

  • Photographs of the problem

Shipping costs will be covered by us.

5. Conditions for accepted exchanges or returns

In order to carry out any exchange or return:

  • The garment must be new, unused, unwashed, and odor-free.

  • It must be sent with its original tags and packaging.

  • With no damage or stains occurring after delivery.
  • Garments showing signs of use, odors, stains, or damage occurring after delivery will not be accepted.

6. Products that do not accept exchanges or returns

For hygiene and health reasons, returns are not accepted for:

  • Bonnets

  • Bibs

  • Pacifier clips

  • Collars

  • Diaper covers
  • Accessories that have direct contact with the baby's skin or mouth
Unless the item is defective from origin.

7. Procedure for requesting an exchange or return

1. Obligation of Prior Notification and Official Channels:

Any claim, withdrawal request, order cancellation, inquiry about delivery delays, or disagreement with the product must be sent, mandatorily and prior to any other action, to our customer service department via our official e-mail info@mimukids.es, to ensure receipt of your request.

2. Absolute Prohibition of Unilateral Action:

Under no circumstances is the Customer authorized to initiate a dispute or chargeback process directly with their bank. Even in the exceptional case that the order has exceeded the stipulated delivery times for logistical reasons or force majeure, the Customer has a contractual obligation to notify us beforehand. If the deadline has been exceeded or there is any incident, our workshop will process the return, refund, or solution internally and immediately. It is strictly forbidden to bypass the company in order to force a bank refund without our prior knowledge and resolution.

3. Regulation of Bank Disputes and Abuse of Rights:

The unilateral opening of a bank dispute, payment reversal, or chargeback procedure by the Customer, deliberately bypassing the company's support channels (in accordance with the exclusion of the right of withdrawal under Art. 103.c of RDL 1/2007 for goods made to consumer specifications), will be considered an unjustified unilateral termination of the contract and an abuse of rights (Art. 7.2 of the Spanish Civil Code).

4. Legal and Economic Consequences of Non-Compliance:

If the Customer initiates a bank chargeback in breach of the stipulated internal claims procedure, the company reserves the right to take the following actions:
  • Suspension of Delivery Obligations: Any work on making, cutting, packaging, or shipping the order subject to the dispute will be immediately halted at our workshop.
  • Passing On Management Costs: The company will charge the Customer a fee for administrative and management costs for defending the dispute before the financial institution, with a minimum amount of €30.00 (or the full fee that the payment gateway charges the company), without prejudice to claiming additional damages incurred.
  • Claim Through Enforcement or Judicial Proceedings: If the Customer wrongfully obtains a reversal of funds after having received the product, or while it is in the process of manufacture within the accepted timeframes, the transaction data (IP address, contractual acceptance logs, GLS courier traceability) will be forwarded to our legal advisors. A summary proceeding for payment claims or a complaint for misappropriation or fraud (Art. 248 of the Spanish Criminal Code) will be initiated, with all resulting judicial, notarial, and representation costs being borne by the Customer.
